NextJet is liable for checked baggage if destroyed, lost or damaged, provided the luggage was checked-in or otherwise under care by NextJet. NextJet is not responsible for any damage caused by the baggage’s characteristics, or by inherent defect or weakness of the baggage. Upon damage to checked baggage, the damaged luggage must be presented and reported to the arrival airport within 7 days of arrival. The passenger is entitled to a maximum amount of 1131 SDR unless presenting a declaration of higher value with regards to the lost baggage.
Baggage delay:
The carrier is liable for damage occasioned by delay in the carriage by air of passengers, baggage or cargo. Nevertheless, the carrier shall not be liable for damage occasioned by delay if it proves that it and its servants and agents took all measures that could reasonably be required to avoid the damage or that it was impossible for it or them to take such measures. If your baggage is not found and delivered to you within 21 days from your arrival, it is considered lost and you are entitled to financial compensation. A declaration of its contents must be submitted to NextJet Customer Relations, e-mail customerrelations@nextjet.se.
Article 18 of the Montreal Convention describes damage to cargo:
1. The carrier is liable for damage sustained in the event of the destruction or loss of or damage to, cargo upon condition only that the event which caused the damage so sustained took place during the carriage by air.
2. However, the carrier is not liable if and to the extent it proves that the destruction, or loss of, or damage to, the cargo resulted from one or more of the following:
a) inherent defect, quality or vice of that cargo;
b) defective packing of that cargo performed by a person other than the carrier or its servants or agents;
c) an act of war or an armed conflict;
d) an act of public authority carried out in connection with the entry, exit or transit of the cargo.
Checked luggage must be able to manage load posed by loading and unloading baggage on the aircraft and/or baggage truck. Checked luggage must also be able to manage load when in contact with other luggage during the loading and unloading process. Checked baggage must be thoroughly packed so that it allows for standard baggage handling, loading and unloading. The passenger is responsible for packing their luggage to prevent its contents from being damaged. The passenger is liable if packing bottles and similar items in the luggage in an event of contaminating other luggage, either belonging to other passengers or the carrier. NextJet does not reimburse or replace damage on checked baggage (own or others) that is a result of broken bottles, leaking food/drinks or equivalent.
Damages to unchecked baggage:
In the case of unchecked baggage, including personal items, the carrier is liable if the damage resulted from its fault or that of its servants or agents.

Air carrier liability for passengers and their baggage.
Summary according to Regulation (EC) No. 2027/97 (as amended by Regulation (EC) No 889/2002). This information notice summaries the liability rules applied by Community air carriers as required by Community legislation and the Montreal Convention.
4.1 Compensation in the case of death or injury
There are no financial limits to the liability for passenger injury or death. For damages up to 113,100 SDRs (approximately SEK 1,000,000) the air carrier cannot contest claims for compensation. Above that amount, the air carrier can defend itself against a claim by proving that it was not negligent or otherwise at fault.
4.2 Advance payments
If a passenger is killed or injured, the air carrier must make an advance payment, to cover immediate economic needs, within 15 days from the identification of the person entitled to compensation. In the event of death, this advance payment shall not be less than 16,000 SDRs (approximately SEK 160,000).
4.3 Passenger delays
In case of passenger delay, the air carrier is liable for damage unless it took all reasonable measures to avoid the damage or it was impossible to take such measures. The liability for passenger delay is limited to 4,150 SDRs (approximately SEK 40,000).
4.4 Baggage delays
In case of baggage delay, the air carrier is liable for damage unless it took all reasonable measures to avoid the damage or it was impossible to take such measures. The liability for baggage delay is limited to 1,131 SDRs (approximately SEK 10,000).
4.5 Destruction, loss or damage to baggage
The air carrier is liable for destruction, loss or damage to baggage up to 1,131 SDRs (approximately SEK 10,000). In the case of checked baggage, it is liable even if not at fault, unless the baggage was defective. In the case of unchecked baggage, the carrier is liable only if at fault.
A passenger can benefit from a higher liability limit by making a special declaration at the latest at check-in and by paying a supplementary fee.
If the baggage is damaged, delayed, lost or destroyed, the passenger must write and complain to the air carrier as soon as possible. In the case of damage to checked baggage, the passenger must write and complain within seven days and in the case of delay within 21 days, in both cases from the date on which the baggage was placed at the passenger's disposal.
4.8 Liability of contracting and actual carriers
If the air carrier actually performing the flight is not the same as the contracting air carrier, the passenger has the right to address a complaint or to make a claim for damages against either. If the name or code of an air carrier is indicated on the ticket, that air carrier is the contracting air carrier.
Any action in court to claim damages must be brought within two years from the date of arrival of the aircraft, or from the date on which the aircraft ought to have arrived.
4.10 Basis for the information
The basis for the rules described above is the Montreal Convention of 28 May 1999, which is implemented in the Community by Regulation (EC) No 2027/97 (as amended by Regulation (EC) No 889/2002) and national legislation of the Member States.
This summary or notice cannot be used as a basis for a claim for compensation, nor to interpret the provisions of this Regulation or the Montreal Convention.
